First, a lawsuit seeking an order for foreclosure is filed.  The lawsuit is served on you, usually by a constable or private process server.  Sometimes it gets served to you via certified mail.  Again, it’s very helpful to open your mail and be informed.
 
The lawsuit process for home equity loans gives you even more time to figure out what you want or need to do with respect to saving your home.  Once the judge signs the order for foreclosure, the lender needs to follow the non-judicial foreclosure steps of giving you at least 21 days notice of sale, followed by a sale date that can only occur on the first Tuesday of a month.
