Bankruptcy Myth 7 - After Bankruptcy Creditors will Continue to Harass

Creditor harassment after bankruptcy is simply illegal. The moment a bankruptcy is filed, something called an “automatic stay” goes into effect. It is like a restraining order that is issued against your creditors. With few exceptions, the automatic stay makes it so that creditors cannot take any collection against you.


With an automatic stay, creditors cannot:

  • Call you
  • Send you bills
  • Foreclose on your home
  • Repossess your vehicle
  • Continue lawsuits

If you can think of a collection activity, it is exceptionally likely that the automatic stay bars it.


If creditors violate the automatic stay by continuing collection activity after you have filed your bankruptcy and after the creditor learns of your bankruptcy, the judge will want to hear about it. Many times we file suit against these creditors to make them stop. Sometimes, you may even be entitled to receive compensation for the violation of your rights. In any case, you would not have to pay for our time if a creditor continually contacts you post bankruptcy. The creditor is required to pay for your legal fees if we are forced to sue them to get you left alone.
